Terms and conditions
1. Scope and contract formation
These terms apply to the creation, provision, hosting and ongoing care of new websites by AZNA Marketing. An enquiry is non-binding and does not create a right to acceptance. AZNA Marketing may decline enquiries. Scope, price, start date and project-specific services are set out in the individual quote; its terms take precedence over these terms.
2. Services and customer cooperation
AZNA Marketing creates new websites within the agreed scope; rebuilding or redesigning existing websites is not included. Hosting, care, small changes and basic SEO are provided only within the agreed scope. Backlink building and ongoing SEO campaigns are not included. The customer supplies required text, images, approvals and legally required information in good time and confirms that the necessary rights are held. Delays caused by missing cooperation extend agreed deadlines reasonably. Additional services and any specific arrangements for security, availability and backups are set out in the quote where required.
3. Prices, payment, term and suspension
The agreed model is either an upfront build fee plus a mandatory website subscription, or no upfront fee with a higher website subscription and an agreed minimum term. The subscription pays for ongoing provision, hosting and care; it is neither an instalment purchase nor a credit agreement. Payments are made by standing order or agreed SEPA direct debit and are due on the date shown on the invoice. No VAT is charged under § 19 UStG. The term and notice period follow the quote; the right to terminate for good cause remains. In the event of substantial payment arrears, AZNA Marketing may temporarily suspend the website after prior notice and expiry of a reasonable payment period. It will be restored within a reasonable time after full payment; mandatory statutory rights remain unaffected.
4. Rights, portfolio use and takeover
Customer content remains the customer's property. AZNA Marketing may showcase the completed, publicly visible website as a reference using the business name, link, extracts and a factual project description unless the customer objects in writing. Confidential content will not be published. After an agreed full takeover and full payment, the customer receives the website files. The customer is responsible for selecting, financing, migrating to and operating its own hosting unless the quote provides otherwise.
5. Liability
AZNA Marketing has unlimited liability for intent, gross negligence and injury to life, body or health. In all other respects, AZNA Marketing is liable only in accordance with statutory law.
6. Language, applicable law and final provisions
Contract documents may be provided in German or English. The English version is supplied as an understandable translation for international customers; if the versions differ, the German version prevails. German law applies. Mandatory consumer protection rules, particularly those at a consumer's habitual residence, remain unaffected. If one provision is ineffective, the remaining provisions continue to apply.
